Injuries and Duty of Care in New Jersey Motorcycle Accidents
The result of a motorcyclist being struck by a car is usually serious injuries endured by the rider, Some common injuries caused by these collisions include:
- Road rash, which can cause infections
- Traumatic brain injuries
- 1st, 2nd, and 3rd-degree burn injuries
- Permanent disfigurement and scarring
- Facial contusions
- Paralysis
- Amputation of one or more extremities
- Fractured or broken bones
- Spinal cord damage
- Death
Injuries of this magnitude demand expensive and continued medical care. Sadly, insurers make it a practice to devalue or undervalue honest claims because their only real purpose is to reduce the payouts made by their company as much as possible.
Each motorcycle accident is distinctive. This can make it hard to figure out if you qualify for compensation without first talking to a Pennsylvania motorcycle injury attorney about your possible claim.
In order to have a legitimate claim, you or your lawyer will be required to show that the four elements of negligence existed. This means you will have to demonstrate that:
- A duty of care was owed: This means that the defendant had a legal duty to take reasonable measures to prevent others from being injured. For example, all drivers have a duty to obey driving laws at all times.
- That duty was violated: You need to show that the defendant breached the duty of care they owed by not engaging in the same action or inaction that a reasonable person would under similar circumstances.
- Causation: You or your attorney will have to show that your injuries were the immediate result of the defendant’s breached duty of care. Meaning had the breach not taken place, the accident and your injuries would not have taken place.
- Damages were created: This part involves proving that the accident forced you to endure monetary losses, like medical costs, lost wages due to being unable to work, property damage, and more. You may also be eligible for recovery for any emotional damages.
