Pedestrian Rights and Safety in Pennsylvania
Taking into account that there is nothing to cushion them from the force of the impact, pedestrians who are involved in a collision with a motor vehicle are extremely susceptible to severe injuries. Serious pedestrian injuries can include broken and fractured bones, blunt force trauma, traumatic brain injury, paralysis, and even death.
Pedestrian accidents occur most frequently in parking lots and at intersections.
In Pennsylvania, drivers always have a duty of care to be aware of pedestrians and act accordingly. In spite of this, pedestrians in Pennsylvania do not always have the legal right of way when it comes to sharing the roadway with vehicles. Due to the fact that drivers have a duty to do everything in their power to avoid striking a pedestrian, they are usually the ones at fault when these types of incidents take place.
A driver’s responsibilities include things like obeying the speed limit, yielding to pedestrians at intersections and in crosswalks, using their turn indicators, and being mindful of their surroundings. Drivers must also demonstrate extra vigilance when they are in the vicinity of pedestrians who seem confused, lost, impaired, disoriented, intoxicated, or disabled.
The overwhelming preponderance of pedestrian accidents takes place because drivers are behaving aggressively, recklessly, or simply not paying attention. When this happens, injured victims or surviving family members of the deceased are entitled to pursue financial compensation by filing a claim of personal injury or a lawsuit against the at-fault party.
Even though most pedestrian injuries are caused by driver negligence, it is essential to keep in mind that pedestrians also have a duty to show caution when near or crossing a roadway.
