Philadelphia, PA (May 21, 2022) – A man was killed during a two-vehicle crash that caused one car to spin out of control on the morning of Saturday, May 21st.
According to police, a 38-year-old man driving a Chevy Equinox northbound along Broad Street was involved in a collision with an oncoming Chevy Suburban when the driver attempted to make a lefthand turn in front of him.
The impact caused the Equinox to spin out, striking a tree and a utility pole. The driver was pronounced dead on the scene. His identity has not been released pending family notification.
The driver of the Suburban, a 68-year-old male, and his 72-year-old female passenger, were both in stable condition.
Officers have said that, although the crash is still under investigation, charges are pending.
We would like to offer our deepest condolences to the family of the deceased victim (Use the name of the victim if we have it) at this time.
Liability in Pennsylvania Failure to Yield Accidents
If you have been injured in a failure to yield crash and want to pursue damages from the negligent driver, you will be required to establish fault for the collision. Failing to yield definitely constitutes negligence and, if successfully proven, would mean that the at-fault driver is liable for your injuries and damages.
Establishing fault can be relatively simple in situations where the negligent driver failed to yield the right of way and struck the victim but it is much more difficult to prove in cases where the victim is the one that hit the vehicle that failed to yield.
If the at-fault driver has availed themselves of even the most rudimentary lawyer, they will attempt to make the most of a confusing situation and claim that you were fully or partially to blame because you were the driver of the striking vehicle. If the respondent is successful in pinning any portion of fault on you, it will negatively affect the amount of compensation you are entitled to.
You can help verify your version of events with various kinds of evidence, including:
- Pictures or videos of the collision scene, especially ones that show where the vehicles are positioned or any debris that was scattered
- Statements from witnesses
- A copy of your police report
- Pictures of the damaged vehicles
